Article 1 : Name
Democracy and Human Rights development Center
Article 2 : Address
- The main site of the center will be in sulaimany.
- It will establish offices in the areas under the control of the Kurdistan Regional
Government according to the requirements of the centers activities.
Article 3 : The Activities of center
- publish the awareness of law, human rights and democracy in the social and
cultural centers.
- Reinforce the judicial awareness of the members work in the filed of
administration and just.
- Prepare Scientific researches on fixing justice of law and reform of judicial and governmental establishments.
Article 4 : The Objectives
- Develop the basis of civil community and equality before the law.
- Creat and encourage the public opinion to change the laws in a way that support with the principles of human rights.
- Found the basis of separating the powers and keeping the independence of the courts.
- Compensate the victims of false law.
- Support the life of those whose rights are not protected by the law.
Article 5 : Definition of center
- It is a non-governmental, politically independent organization believes in settling the rule of law and promoting respect for the principles of human rights
- It works for a civil community , democracy , respecting human dignity and fixing the justice of law.
Article 6 : The center Council
First: it consist of five main members , it is the highest authority in the center.
Second: the terms of membership in the council are:
- He / she should not be sentenced for an unsocial or moral crime
- He / she should have a social , educational or scientific personality.
- He / she performs no activity against the objectives of the center.
- He / she should not be under the age of (18) years old.
Third: Each Member of the Centre would not be Considered as a member if:
- He / she dies.
- His / Her application of resign is accepted , or He / she offers resign application and the council does not answer his / her application after (30) days.
- The member is discharged when:
- He / she is sentenced for a nonpolitical or moral crime.
- He / she causes moral or material loss to the center.
- He / she dosse not participate in two sessions of the council one after another without a reasonable justification.
- He / she dose not obey the centers principles of working.
Article 7 : Council Duty and Authority
- Responsible of keeping the relation of the center with the interior system.
- Responsible of achieving the objectives of the center.
- Make annual plan and the budget of the center.
- Approve the final account of the last year.
- Make strategic planning for the centers activities.
- Appoint manager , assist and manager and the administration staff. Appoint their salaries , accept their resign application or discharge them or punish the.
- Decide on ending the membership the council members according to Article 3 in this system.
- Decide on doing change in the interior system according to the identified
laws.
Article 8 : The Council Meeting
- The council meets every three months in normal case.
- If 2/3 of the council members ask to meet.
- Specil meeting will be held on the request of the administration staff to decide on the content of the request.
- All the meeting held with the presence of more than the half of the members are legal.
Article 9 : Administration Staff
First: It consists of five members including manager , assist manager and heads of departments.
Second: Administration Structure
- Manager.
- Head of Media and Awareness Department
- Head of Research Department.
- Head of administration and finance.
- Head of Relation Department.
Third: The terms of Administration staff member.
- He / she should not be under the age of (18) years.
- He / she should be specialized in his / her filed of work.
- He / she should not be sentenced for an apolitical or moral crime.
- He / she should be patriotic.
Fourth: Administration Staff duty and Authority
- Administrate the duty and activities of the center according to the decided
plan.
- Make administration resolution and advice to:
- Appoint the employees (officials) the departments , and advisors according
to the terms of assignment and specifying their salaries.
- Change the post of the heads of departments.
- Discharge the departments officials , advisors and employees. Accept their
resign applications.
- Invite t he council of the center for the regular and annual meetings.
- Form specialized committee to perform the activities.
- Prepare the final accounting of the last year and estimate the budget of the
new year.
Fifth: Rights of Administration staff Members
- Receive a monthly salary.
- Express their attitudes . views and comments freely
- protect himself / herself in punishment
Article 10 : Duty & Administration of Administration staff Manager
- Supervise the meeting of the administration staff.
- prepare the quarterly and annual report on the centers activities and finance
and raise them to the council of the center.
- Excute the works and activities of the departments.
- Supervise the works and activities of the departments.
- Represent the center before the council, concerned establishments and parties.
- When the manager takes permission or resigns or dismissed , the assist manager will be responsible for his / her duties and authorities.
Article 11 : The principles of Centers Work
- Keep democracy
- Respect the principles of human rights.
- Respect the law.
Article 12: Centers Relation with the Kurdistan Regional Government
The center will be in close relation with the using laws of the Kurdistan Regional Government in general and the laws of non – government al organizations in particular.
Article 13 : General Punishments
First: The punishments in council and the administration staff are as following :
- Warning
- drawn attention
- solidification
- Dismissing
Second: Each punishment mentioned in the first paragraph is according to the type and degree of the disobedience.
Article 14 :
First: Financial Sources
- The assist and of Kurdistan Regional Government.
- The assistant of charitable organizations
- (Charitable) Aid
Second: The center obeys the rules of accounting and finance control of Kurdistan Regional Government according to the united accounting system in finance registration and final accounting.
Article 15 : Centers Relation with Cooperators
The centers relation with t he cooperators according to the basis of centers working depends on the manner of non- governmental organizations in the frame of law.
Article 16:
The center has the ownership right of movable and immovable properties.
Article 17 : Abolish the Center
- By the majority of vote . the center council can decide on abolishing the center and states the reasons and informs the ministry of Relation and cooperation.
- After the center is abolished all its movable and immovable properties will be given to a center or an establishment whose objectives or a part of its objectives are close from the centers objectives.
Article 18 : Unite of Center
- The center has the right to unite with a non- governmental local organization whose objectives are close to the centers.
- The center has the right to be a member of another organization.
Article 19 : Registrations of center
First: The Council registrations
- Registration of the councils meetings.
- Registration of the councils resolutions and advises ( recommendations)
- Registration of approving the councils accounting file.
Second: The Administration Staff Registrations
- Registration of the meeting of the administration staff.
- Registration of administrative resolutions and recommendations.
- Registration of projects
- Registration of Incoming and Outgoing
- Registration of Accounting
- Registration of general daily
Third: The registrations of the council are supervised by the council and the registration of the administration staff are supervised by the administration staff.
Article 20 : Joint Meeting
First: The center council and the administration staff hold joint meeting once ayear or more than one time.
Second: the subject of the meetings are:
- Evaluate the center in general and the annual working plan.
- Suggest the change in the interior system.
Third: the joint meeting is legal if the number of the council members and the number of the administration staff members are equal to the number of their private legal meetings.
Fourth: Members of administration staff have the right to vote on the issues that are under the authority of the council and raised in the joint meeting
Article 21 : Administration Staff Meetings
First: On the invitation of manager or assistant manager (if the manager is absent ) the administration staff holds regular monthly meeting
Second: On the invitation of the manager or 2/3 of staff members the irregular meeting can be held.
Third: the meeting with the presence of 2/3 of the staff members are legal
Fourth: The resolutions are made by the majority.
Article 22 : General Rules
- There should not be a 1st and 2nd degree relative relationship among the members of the council and the administration staff.
- The responsibility of each member in the council and the administration staff is in the frame of the duty identified for him / her.
